Vietnam's Labor Code 2019 does not mandate a 13th-month salary as a standalone statutory requirement. However, if it is written into an employee's labor contract, a collective bargaining agreement, or your company's internal labor regulations, it becomes a legally binding obligation — not optional.

In practice, the 13th-month salary is near-universal in Vietnam, typically paid in January or February ahead of Lunar New Year. Skipping it — even if not contractually required — is one of the fastest ways to lose talent in a competitive market. Most offshore employers budget for it as a fixed annual cost equivalent to one month's salary.

The 13th-month payment is subject to PIT and must be included in reporting. Talent JDI factors this into the December–January payroll cycle and advises clients on how to structure it compliantly in employment contracts.
